These Terms of Service govern your access to and use of Sparks Scribe, operated by Sparks Support Pty Ltd ("we", "us", or "our"). By creating an account or using Sparks Scribe, you agree to these terms and our Privacy Policy.
You must be at least 18 years old and able to form a binding contract to use Sparks Scribe. You are responsible for:
• Maintaining the security of your login credentials
• Ensuring your account details are accurate
• All activity that occurs under your account
If we suspect misuse, we may suspend or terminate access at our discretion.
Sparks Scribe is a digital documentation and administration tool designed for independent workers, sole traders, and teams in the disability support sector.
You agree not to:
• Use Sparks Scribe for unlawful, misleading, or harmful purposes
• Input, upload, or share inappropriate or unauthorised content
• Attempt to bypass or interfere with security measures
• Resell or reverse-engineer the service
Sparks Scribe is offered on a paid subscription basis via Stripe. By subscribing, you agree to:
• Pay applicable fees for monthly or annual access
• Maintain valid payment information
• Notify us of billing issues within 7 days
You may cancel your subscription at any time. We offer a 14-day refund from your initial signup date.
Sparks Scribe, including its interface, code, branding, and documentation, is protected by copyright and intellectual property laws. You retain ownership of content you input. We reserve the right to de-identify and analyse aggregated data for platform improvement.
Your information is handled in accordance with our Privacy Policy. We store data securely on Australian-based servers, encrypt data at rest and in transit, and comply with the Australian Privacy Principles. You are responsible for ensuring the accuracy of your data entries and exported documents.
Sparks Scribe is a documentation and record-keeping tool. Nothing in Sparks Scribe — including prompts, alerts, templates, generated documents, or any other feature — constitutes legal, medical, or compliance advice.
Specifically:
• Sparks Scribe is not a compliance authority. It does not determine whether your documentation meets any regulatory standard.
• Using Sparks Scribe does not make you compliant with NDIS requirements, registered provider obligations, or any other legal or professional standard.
• Safeguarding prompts and alerts are designed to help you notice things. They are not determinations of what you must report or how you must act.
• Sparks Scribe does not guarantee audit readiness. Using the platform does not mean you will satisfy any auditor, regulatory body, or registration standard.
• You remain solely responsible for understanding and meeting all legal, professional, and regulatory obligations that apply to your work.
. Participant Data — Your Responsibility
When you use Sparks Scribe to enter, store, or process information about the people you support:
• You confirm you have the authority, consent, or lawful basis to collect and store that information.
• You are responsible for how you use, share, export, or handle participant information within and outside the platform.
• You are responsible for informing participants, where appropriate, that their information is being stored in a digital platform.
• Sparks Scribe processes information on your behalf. The responsibility for appropriate handling of participant data rests with you.
Sparks Support Pty Ltd is not responsible for how users choose to enter, use, or handle participant information within the platform.
App Costs — Business Expenses
The cost of your Sparks Scribe subscription is a business overhead. It is not a claimable NDIS participant support cost.
• You must not pass the cost of your Sparks Scribe subscription on to a participant's NDIS plan unless you have specific, independent legal authority and participant agreement to do so.
• An invoice generated in Sparks Scribe does not constitute confirmation that a charge is valid or claimable under a participant's NDIS plan. You are responsible for ensuring all charges are appropriate and lawful.
We aim to provide reliable service but cannot guarantee uninterrupted access. We reserve the right to modify or discontinue features at any time. We are not liable for data loss outside our control, user error, unauthorised access, or delays caused by third-party platforms.
You may delete your account at any time. We may suspend or terminate your access if you breach these terms, we detect misuse or a security risk, or you fail to pay subscription fees.
To the extent permitted by law, Sparks Scribe is provided 'as is' and 'as available'. We are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid in the previous 3 months.
These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of that jurisdiction.
